CONTROLLING LAW

These Terms and Conditions are governed by the substantive laws of the United States of America, if applicable, and the laws of the State of New Mexico, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts in Santa Fe, New Mexico. If any provision of these Terms and Conditions are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining Terms and Conditions, which shall remain in full force and effect. No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of these Terms and/or Conditions. These Terms and Conditions constitute the entire agreement between you, the user, and the New Mexico Department of Cultural Affairs with respect to the use of the DCA Web sites. No changes to these Terms and Conditions shall be made or effective unless posted on this DCA Web site by the New Mexico Department of Cultural Affairs.
