Compliance Policy

New Mexico Arts and any organization or individual who contracts with New Mexico Arts as a recipient of state or federal public funds, property or equipment, is required to comply with Title II, subtitle A of the Americans with Disabilities Act of 1990 (ADA), and Section 504 of the Rehabilitation Act of 1973.  Title II of the ADA prohibits discrimination against qualified individuals with disabilities in all programs, activities, and services of public entities; and in all federally assisted programs and activities.

Questions concerning the ADA and Section 504, and requests for accommodations should be directed to the New Mexico Arts’ ADA/504 Coordinator at the below address. Public documents are available in alternative formats upon request. Accommodation requests for a specific event should be made at least one (1) week prior to the event, program or activity.

Grievance Procedure

Complaints concerning possible violations or noncompliance with Title II of the ADA or Section 504 of the Rehabilitation Act, as amended, should be submitted to the Executive Director of New Mexico Arts within 30 days of the occurrence, program or activity. 

  1. Complaints should be directed to:

  2. Reports or complaints of possible noncompliance or violations shall:
    1. be in writing;
    2. state the complainant’s full name, address and telephone number;
    3. identify the specific contractor (organizations, program, or person) against whom the complaint is made;
    4. identify the date of the incident;
    5. contain a description of the complaint with as much detail as possible;
    6. contain other information that may be necessary to support the complaint (including the possible violations of the ADA and any efforts made to resolve the complaint);
    7. contain suggestions for resolving the complaint;
    8. and be signed by the complainant
  3. Do not send original documents, retain all originals.
  4. The Executive Director or her/his designee will use the resources of New Mexico Arts to review the complaint and, when necessary, take appropriate action which may include without limitation, informing the Arts Commission of the findings of the review and investigation.
  5. A complaint will not result in immediate loss of state funding.
  6. A written response to the complaint will be issued within 30 days from the date the complaint was received by New Mexico Arts.
